Welcome to 20 Deep Winery. By using our website or purchasing our products, you agree to these terms. We’ve tried to keep it straightforward, but this is a legal document that protects both you and us.
ACCEPTANCE OF TERMS
By accessing, browsing, or using this website (www.20deep.com), making a purchase, registering for an event, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree to these terms, please do not use our website or services.
AGE REQUIREMENT AND ALCOHOL SALES
You must be 21 or older to purchase alcohol from us. By placing an order, you confirm that you meet this legal requirement and that the information you provide is accurate.
We will verify your age at the time of delivery or pickup:
– Pickup orders: Valid government-issued photo ID is required
– Shipping orders: Adult signature (21+) is required at delivery
We reserve the right to refuse any sale if we cannot verify that the purchaser is of legal drinking age.
It is illegal to purchase alcohol for anyone under the age of 21. By completing a purchase, you certify that you are purchasing alcohol for personal consumption and not for resale or distribution to minors.
ACCOUNT REGISTRATION
To make purchases or register for events, you may need to create an account. You agree to:
– Provide accurate, current, and complete information
– Maintain the security of your password and account
– Notify us immediately of any unauthorized use of your account
– Accept responsibility for all activities that occur under your account
We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent activity.
ORDERS AND PAYMENT
PLACING ORDERS
When you place an order through our website, you are making an offer to purchase products at the prices stated. We reserve the right to accept or decline your order for any reason, including but not limited to:
– Product availability
– Errors in pricing or product information
– Suspicion of fraudulent activity
– Inability to verify age or shipping address
All orders are subject to acceptance and availability.
PRICING
All prices are in U.S. dollars and include applicable New York State sales tax (8%) where required. Prices are subject to change without notice, but any changes will not affect orders you have already placed and confirmed.
We make every effort to ensure pricing accuracy, but errors may occur. If we discover a pricing error after you’ve placed an order, we will notify you and give you the option to either:
– Cancel the order and receive a full refund, or
– Complete the purchase at the correct price
PAYMENT
We accept major credit cards and gift cards through Square, our secure payment processor. Payment is processed when you place your order.
By providing payment information, you represent and warrant that:
– You are authorized to use the payment method
– The information you provide is accurate and current
– You will pay all charges incurred
We do not store your full credit card information on our servers. All payment processing is handled securely by Square.
ORDER CONFIRMATION
You will receive an email confirming your order once it has been successfully placed and payment has been processed. This confirmation does not constitute acceptance of your order—it simply confirms we have received it.

Wednesday & Sunday: 11am – 7pm
Thursday, Friday & Saturday: 11am – 9pm
ORDER READY TIME
Orders placed before 3pm will be ready for pickup the same day during our business hours. Orders placed after 3pm will be ready the next business day. You will receive an email notification when your order is ready for pickup.
PICKUP PROCESS
When you arrive:
1. Come to the tasting room
2. Provide your name and order number to the bartender
3. Present a valid government-issued photo ID (we will verify you are 21+)
4. Your order will be retrieved from behind the bar
UNCLAIMED ORDERS
If you do not pick up your order within 30 days of notification, we will automatically issue a full refund to your original payment method and restock the items. If you need additional time, please contact us at (585) 204-7953 or info@20deep.com.
CANCELLATIONS AND CHANGES
You may cancel or modify a pickup order at any time before you pick it up by contacting us. Cancellations will receive a full refund to the original payment method.
SHIPPING
SHIPPING AREA
We ship wine directly only within New York State due to state regulations. Shipping is available to customers with New York shipping addresses only.
For orders to other states, you will be redirected to our fulfillment partner VinoShipper (vinoshipper.com/shop/20_deep), who handles nationwide wine shipping in compliance with state-by-state regulations.
SHIPPING COSTS
Shipping costs are calculated at checkout based on your location within New York State. We offer:
– Standard Shipping: Flat rate of $20 per order
– Local Pickup: Free
SHIPPING TIME
Orders typically ship within 1-2 business days of order confirmation. Delivery times vary based on carrier and destination, but most New York deliveries arrive within 3-5 business days.
We are not responsible for delays caused by weather, carrier issues, or other circumstances beyond our control.
SHIPPING RESPONSIBILITY AND RISK OF LOSS
We will package your order with care to prevent damage during shipping. Once your order is picked up by the carrier, the risk of loss and title transfer to you. We are not responsible for:
– Delays in delivery
– Lost or stolen packages
– Damage that occurs during transit (though we will work with you to file claims with the carrier)
DELIVERY REQUIREMENTS
An adult signature (21+) is required for all wine deliveries. Someone must be present at the delivery address to sign for the package. If no one is available to sign, the carrier will attempt redelivery or hold the package at a local facility for pickup.
We cannot ship to P.O. boxes.
DAMAGED OR DEFECTIVE SHIPMENTS
If your wine arrives damaged (broken bottles, leaking, etc.) or is defective (corked, spoiled, etc.), please contact us within 30 days of delivery. We will:
– Replace the damaged or defective bottles at no charge, or
– Issue a refund for the affected items
To report damaged or defective wine, please email info@20deep.com with:
– Your order number
– Photos of the damaged product and packaging
– Description of the issue
CANCELLATIONS
Shipping orders cannot be cancelled once they have been shipped. If you need to cancel a shipping order, please contact us immediately at info@20deep.com or (585) 204-7953. If we can intercept the order before it ships, we will cancel it and issue a full refund.
RETURNS, REFUNDS, AND REPLACEMENTS
NO RETURNS POLICY
Due to alcohol regulations and the perishable nature of wine, we cannot accept returns on wine bottles that have been picked up or delivered. All sales are final once the product is in your possession.
DAMAGED OR DEFECTIVE PRODUCTS
If a bottle arrives broken, damaged, or is defective (corked, oxidized, or otherwise flawed), we will replace it or issue a refund. You must report the issue within 30 days of receiving or picking up your order.
To report an issue:

2. Provide your order number
3. Include photos of the damaged product (if applicable)
4. Describe the problem
We may ask you to return the defective bottle for inspection, or we may ask you to dispose of it per our instructions.
PICKUP ORDER CANCELLATIONS
Pickup orders may be cancelled at any time before pickup for a full refund. To cancel, contact us at info@20deep.com or (585) 204-7953.
SHIPPING ORDER CANCELLATIONS
Shipping orders may only be cancelled before the order ships. Once shipped, the order cannot be cancelled, but damaged or defective items will be replaced per our policy above.
REFUND PROCESSING
Approved refunds will be issued to your original payment method within 5-7 business days of approval. Depending on your financial institution, it may take additional time for the refund to appear in your account.
WRONG ITEM SHIPPED
If you receive the wrong item, please contact us immediately at info@20deep.com. We will arrange for the correct item to be sent to you at no additional charge and provide instructions for returning the incorrect item.
EVENTS AND RESERVATIONS
EVENT REGISTRATION
When you register for an event (such as tastings, dinners, or special experiences), you agree to:
– Provide accurate contact information
– Arrive on time for your reservation
– Comply with our tasting room policies
– Be 21 years of age or older (valid ID required)
EVENT CHANGES AND CANCELLATIONS
We reserve the right to modify, reschedule, or cancel events due to circumstances beyond our control (weather, low attendance, etc.). If an event is cancelled, we will:
– Notify you as soon as possible via email or phone
– Offer you the option to transfer to another event date, or
– Issue a full refund
If you need to cancel your event registration, please contact us at least 48 hours in advance for a full refund. Cancellations made less than 48 hours before the event may not be eligible for refunds.
GIFT CARDS
PURCHASE AND USE
Gift cards are available for purchase in preset amounts or custom amounts through Square. Gift cards can be used:
– At our tasting room for wine purchases, tastings, merchandise, and food
– Online for wine purchases
NON-REFUNDABLE
Gift cards are non-refundable once purchased. However, they can be used to purchase any products or services we offer.
NO EXPIRATION OR FEES
Gift cards never expire and have no dormancy, inactivity, or service fees.
LOST OR STOLEN CARDS
We are not responsible for lost or stolen gift cards. Gift cards are treated like cash. If your gift card is lost or stolen, we cannot replace it unless you can provide proof of purchase and the card has not been used.
COMBINABLE WITH OTHER PAYMENT METHODS
Gift cards can be combined with other payment methods (credit cards, debit cards) to complete a purchase if the gift card balance is insufficient.

PRODUCT INFORMATION AND AVAILABILITY
ACCURACY
We strive to provide accurate product descriptions, images, and specifications. However, we do not warrant that product descriptions, images, prices, or other content on our site is accurate, complete, reliable, current, or error-free.
Tasting notes and product descriptions are subjective and may vary based on individual palates and preferences.
AVAILABILITY
Products are subject to availability. If a product becomes unavailable after you place an order, we will notify you and offer:
– A substitute product of equal or greater value (with your approval), or
– A full refund for the unavailable item(s)
LIMITED QUANTITIES
Some wines are produced in limited quantities. We reserve the right to limit the quantities of products sold to any person or household.
WINE VARIABILITY
Wine is a natural product and may vary slightly from bottle to bottle and vintage to vintage. Variations in color, aroma, and taste are normal and do not constitute a defect.
INTELLECTUAL PROPERTY
All content on this website—including but not limited to text, graphics, logos, images, wine labels, photographs, videos, and software—is the property of 20 Deep Winery, LLC and is protected by United States and international copyright, trademark, and other intellectual property laws.
You may not:
– Copy, reproduce, republish, upload, post, transmit, or distribute any content without our prior written consent
– Use our trademarks, logos, or brand names without permission
– Create derivative works based on our content

LIMITED LICENSE

– Any unauthorized access to or use of our servers and/or any personal information stored therein

SPECIFIC LIMITATIONS
We are not responsible for:
– Delays or failures due to circumstances beyond our control (severe weather, natural disasters, strikes, carrier delays, etc.)
– Losses resulting from carrier mishandling (though we will assist with filing claims)
– Issues caused by incorrect shipping or contact information you provide
– Spoilage due to improper storage after delivery or pickup
– Personal injury resulting from alcohol consumption
INDEMNIFICATION
You agree to defend, indemnify, and hold harmless 20 Deep Winery, LLC, its owners, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney’s fees) arising from:

– Your violation of these Terms and Conditions
– Your violation of any third party rights, including intellectual property rights
– Any false or misleading information you provide
– Your purchase, possession, or consumption of alcohol purchased from us
DISPUTE RESOLUTION
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
GOVERNING LAW
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.
INFORMAL DISPUTE RESOLUTION
We want to address your concerns without formal legal proceedings, if possible. Before filing a claim, you agree to try to resolve the dispute informally by contacting us at info@20deep.com or (585) 204-7953. We’ll attempt to resolve the dispute informally by contacting you via email. If a dispute is not resolved within 30 days of submission, you or 20 Deep Winery may bring a formal proceeding.
BINDING ARBITRATION
You and 20 Deep Winery agree that any dispute, claim, or controversy arising out of or relating to these Terms and Conditions or your use of our website or services (collectively, “Disputes”) will be settled by binding arbitration, except as set forth below. This includes disputes arising out of or relating to interpretation or application of this arbitration provision, including its enforceability, revocability, or validity.
ARBITRATION RULES AND FORUM
The arbitration will be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect, except as modified by this arbitration provision. The AAA Rules are available at www.adr.org or by calling 1-800-778-7879.
The arbitration will be conducted in Monroe County, New York, or another mutually agreeable location. If your claim is for $10,000 or less, you may choose whether the arbitration will be conducted:
– Solely on the basis of documents submitted to the arbitrator
– Through a telephonic or video conference hearing
– By an in-person hearing as established by the AAA Rules
Payment of all filing, administration, and arbitrator fees will be governed by the AAA Rules. If your claim is for $10,000 or less, we will reimburse you for all filing, administration, and arbitrator fees if the arbitrator rules in your favor.
ARBITRATION DECISIONS
The arbitrator’s decision will include the essential findings and conclusions upon which the arbitrator based the award. The arbitrator may award any relief that a court could award, including attorney’s fees when authorized by law. The arbitrator’s award is binding and may be entered as a judgment in any court of competent jurisdiction.
CLASS ACTION WAIVER
YOU AND 20 DEEP WINERY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, REPRESENTATIVE, OR COLLECTIVE ACTION OR PROCEEDING.
Unless both you and 20 Deep Winery agree otherwise, the arbitrator may not consolidate or join more than one person’s or party’s claims and may not otherwise preside over any form of a consolidated, representative, class, or collective proceeding.
The arbitrator may award relief (including monetary, injunctive, and declaratory relief) only in favor of the individual party seeking relief and only to the extent necessary to provide relief necessitated by that party’s individual claim(s). Any relief awarded cannot affect other users.
If a court decides that applicable law precludes enforcement of any of this paragraph’s limitations as to a particular claim for relief, then that claim (and only that claim) must be severed from the arbitration and may be brought in court. If this class action waiver is found to be unenforceable, then the entirety of this arbitration provision shall be null and void.
EXCEPTIONS TO ARBITRATION
Notwithstanding the above, you or 20 Deep Winery may bring an individual action in small claims court if the claim qualifies for small claims court in the jurisdiction where the action is brought.
Additionally, either party may seek emergency equitable relief before a court in order to maintain the status quo pending arbitration. A request for interim measures shall not be deemed a waiver of any other rights or obligations under this arbitration provision.
OPT-OUT OF ARBITRATION
You have the right to opt out of this arbitration provision within 30 days from the date you first use our website or services or agree to these Terms and Conditions (whichever is earlier). To opt out, you must send written notice to:

If you opt out of this arbitration provision, all other parts of these Terms and Conditions will continue to apply. Opting out of this arbitration provision has no effect on any previous, other, or future arbitration agreements that you may have with us.
JURISDICTION (IF ARBITRATION DOES NOT APPLY)
If for any reason a claim proceeds in court rather than in arbitration, you agree that any legal action or proceeding arising out of or relating to these Terms and Conditions or your use of our website shall be brought exclusively in the state or federal courts located in Monroe County, New York. You consent to the jurisdiction of such courts and waive any objection to venue in such courts.
SEVERABILITY
If any provision of these Terms and Conditions is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
WAIVER
Our failure to enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision. No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.
ENTIRE AGREEMENT
These Terms and Conditions, together with our Privacy Policy and any other policies or agreements referenced herein, constitute the entire agreement between you and 20 Deep Winery, LLC regarding your use of our website and services, and supersede all prior agreements and understandings.
CHANGES TO TERMS
We reserve the right to modify these Terms and Conditions at any time. We will notify you of any material changes by:

FORCE MAJEURE
We shall not be liable for any failure to perform our obligations under these Terms and Conditions where such failure results from any cause beyond our reasonable control, including but not limited to:
